Please read these Terms of Service ("Terms") carefully before using the Kairora mobile application and related services operated by Kairora ("we", "us", or "our").

1. Acceptance of Terms

By downloading, accessing, or using the Kairora app, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the app.

2. Description of Service

Kairora is a trading journal application with psychology tracking features. The service allows users to:

• Log and track trades with entry, mid-trade, and exit mindset entries
• Record emotions, notes, and reflections on trading decisions
• Receive AI-generated insights about trading patterns and psychological triggers
• Track progress through gamification elements (points, streaks, badges)
• Sync data across devices via cloud storage

We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. Eligibility

You must be at least 18 years old to use Kairora. By using the app, you represent and warrant that you meet this age requirement.

4. Account Registration

• You must provide accurate and complete account information
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access
• We reserve the right to suspend or terminate accounts that violate these Terms

5. User Content

You retain ownership of the trading data, notes, and other content you submit to Kairora. By submitting content, you grant us a license to store, process, and display that content solely for the purpose of providing the service.

You are responsible for ensuring your content does not violate any laws or third-party rights. We do not claim ownership of your data.

6. AI-Generated Insights

Kairora uses artificial intelligence to analyze your trading patterns and generate insights. You acknowledge that:

• AI insights are for informational and educational purposes only
• AI-generated content may not be perfectly accurate or complete
• We do not guarantee the accuracy, reliability, or usefulness of AI insights
• You should not make trading decisions based solely on AI recommendations
• We limit AI processing through daily budgets and rate limits to control costs and ensure fair usage

8. Subscription & Payments

Certain features of Kairora may require a paid subscription. If you subscribe:

• Fees are billed in advance on a monthly or annual basis
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel at any time through your app store account settings
• Refunds are handled according to the app store's policies (Apple App Store, Google Play Store)
• We may change subscription fees with notice

9. Acceptable Use

You agree not to:

• Use the app for any illegal purpose or in violation of any laws
• Attempt to access other users' data or bypass authentication
• Reverse engineer, decompile, or disassemble the app
• Use automated systems to scrape or access the service
• Interfere with or disrupt the app's servers or infrastructure
• Impersonate any person or entity or provide false information

Your use of Kairora is governed by our Privacy Policy. We collect and process data as described in the Privacy Policy, including:

• Account and authentication information
• Trading journal entries and mindset data
• Behavioral and gamification data
• Device and technical information

11. Intellectual Property

Kairora and its original content, features, and functionality are owned by Kairora and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

12. Termination

We may suspend or terminate your access to Kairora at any time, with or without cause, with or without notice. Upon termination:

• Your license to use the app ends immediately
• You may request export or deletion of your data as described in the Privacy Policy
• Provisions of these Terms that should survive termination remain in effect

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The app will be uninterrupted, secure, or error-free
• Defects will be corrected
• The app or servers are free of viruses or harmful components
• AI insights will be accurate, complete, or useful
• Your trading performance will improve as a result of using the app

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIRORA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING FROM OR RELATING TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO KAIRORA IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANYTHING.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify, defend, and hold harmless Kairora from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the app, your content, your violation of these Terms, or your violation of any rights of another party.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Kairora operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of Kairora after changes constitutes acceptance of the updated Terms.
